Fault

Determining who is at fault in a traffic accident is a matter of determining who is negligent. Common sense may direct you to a particular conclusion as to who is at fault, but not necessarily what rule the person violated to constitute a claim for negligence. Traffic signal devices, traffic ordinances, rules of the road and state statutes must be consulted, and evidence must be preserved.

A claimant’s failure to investigate and present evidence supporting each and every element of a claim for injuries will likely produce undesirable results.
