Maintenance

In a proceeding for divorce or legal separation, a court may also award maintenance. Maintenance is spousal support which some people also call alimony.  Courts do not frequently award maintenance and a spouse seeking maintenance bears the burden to prove that he or she is entitled to maintenance.  Maintenance can be ordered in any amount and for any duration of time as determined by the court. In determining an award of maintenance, a court will consider any number of factors including, but not limited to, the financial resources of the spouses, the standard of living established during the marriage, the length of the marriage, the age and physical condition of the spouses, the conduct of the parties during the marriage, and any other relevant factors. A person seeking maintenance must be thoroughly prepared to present evidence in support of his or her request for maintenance as maintenance is difficult to prove and is not commonly awarded.
