Legal Separation

Legal Separation is the process by which married couples initiate the process to divide their marital assets and debts in contemplation of living separate and apart even though the parties are not getting divorced.  The parties can also work out issues related to child custody and child support.  There are any number of reasons why a husband and wife may seek a legal separation. Parties separate rather than divorce for religious reasons, in circumstances where a spouse has a gambling problem, and in some circumstances where a spouse continues to engage in financial misconduct.
